Fall 2024 – Clearwater Beach, FL

The Fall 2024 Meeting was held December 4th through 5th. The meeting was virtual due to the cancellation of the in-person meeting in Clearwater Beach.  This was a packed meeting with several speakers and a lot of information shared with attendees.  Representatives from Alabama, Florida, Oklahoma, and the National Insurance Crime Bureau (NICB) presented during the meeting.  Their key updates included:

Alabama DOR – Alabama shared that their uninsured motorist rate as of 2022 was 14.2%. They are anticipating a decrease in this rate as they are observing a decrease in MLI notices sent and reinstatement fees.

Florida Department of Highway Safety and Motor Vehicles – HB215 went into effect 7/1/2024 which provides that motor vehicle insurance coverage issued by risk retention groups, operating under federal law, satisfies financial responsibility requirements under state motor vehicle law. There is still an interest in OLV.  A bill may be introduced Q1 2025. Florida’s website now provides updates on technical issues. The new random character driver’s license number has not created any challenges from a reporting perspective.

Oklahoma UVED Program – Everything continues to run smoothly with this program, and they are not observing a high number of repeat offenders. Their system is utilized for registration renewal and law enforcement use.

NICB – Two representatives from the Tampa office presented current trends, with more automobile related focus.  The first part of the presentation discussed current trends and criminal activities the NICB is seeing. Examples included medical related, vehicle theft and cloning, exporting vehicles from the United States.  The second part of the discussion focused on regulatory efforts that are being implemented to help address insurance related crime and fraud.  A couple of model legislation examples included the Auto Glass and Catalytic Converter legislations, both from 2024.  Top vehicle-related trends for bills introduced included:  Vehicle Theft, Vehicle Parts Theft and Fraud, and Towing.  This was a very engaging and informative topic.

Other key state updates include:

  • Delaware – State implemented new versions of the Notice of Cancellation or Termination of Policy (FR4), the State of Delaware Insurance Certification (FR19), and the Delaware Uninsured Vehicle Report (FR1) in July of 2024.
  • Idaho – IICMVA model, implemented 12/1/2023, has resulted in major process improvements and accuracy for insurance verification. Effective 1/1/2025, state is mandating electronic filing of all SR-22 and SR-26 forms through IDIVS.
  • Louisiana – State is working to modernize their system and anticipates sunsetting their legacy transactional reporting in Q1 2025.
  • Maryland – State is implementing BOB reporting with mandatory OLV effective 1/1/2025.
  • Missouri – State continues to work towards implementation of an auto liability reporting system, enacted by SB398. The bill was revised to extend the implementation date to Q4 2027.
  • Nevada – Nevada IVS was implemented on 7/31/2024 with discontinuation of the prior system occurring simultaneously.
  • North Carolina – State is running both BOB/OLV and transactional reporting systems. There is currently no timeline for sunsetting transactional system.
  • Rhode Island – State has shortened timeframe of suspension letter process from 90 to 30 days.
  • Utah – HB184, effective 1/1/2025, expands reporting requirements to include street legal ATVs along with motorboats and sailboats. SB135 was amended to also include roadable aircraft.  IICMVA has shared concerns with the timeline but has not received a response.  Discussions between the trades and legislatures have occurred to delay the implementation date.
